The Civil Guard investigates a young man for driving without a license, drunk and in the opposite direction (09/12/2020)

The driver has been investigated for the alleged responsibility of three crimes against security, for driving without a license, doing so under the influence of alcoholic beverages and reckless driving. The action took place when the Traffic Operational Center (COTA) of the Murcia Civil Guard Traffic Sector / Subsector was alerted to a traffic accident, at kilometer 27,400 of the N-332 road (Cartagena-Valencia ), municipality of Los Alcázares, in which two vehicles were involved. A motorcyclist patrol from the Cartagena Traffic Detachment and a team of the Los Alcázares Local Police traveled to the scene and verified that it was a frontal-lateral collision between two cars, in which only material damage had been caused to the vehicles involved. Apparently, the accident occurred when one of the drivers improperly joined the AP-7 motorway from San Javier (exit 782), driving towards Cartagena on the lanes towards Alicante, traveling about four kilometers in the opposite direction to the stipulated until joining the N-332 where it collided with another user of the road. After attending to both drivers, the officers identified the person who was driving in the opposite direction, who also showed signs of having ingested some substance incompatible with driving. After being subjected to the mandatory breathalyzer tests, it gave a positive result of 0.72 and 0.59 milligrams of alcohol per liter of exhaled air, more than double the maximum allowed rate of 0.25 mg / liter . The young driver, of Moldovan nationality, 20 years old and a resident of Torrevieaja (Alicante), also lacked administrative authorization to drive, having never obtained it. For all these reasons, he was investigated as the alleged perpetrator of three crimes against road safety, driving in a manifestly reckless manner (opposite direction on the highway) putting the life or integrity of other users in concrete danger, driving a motor vehicle under the influence of alcoholic beverages and driving without ever obtaining a driving license.

It was also proposed for administrative sanction for lacking the mandatory insurance vehicle. The person investigated and the proceedings brought were made available to the Investigating Court number 1 of San Javier (Murcia). The crime of reckless driving is contained in article 380 of the Penal Code and can be punished with prison terms of 6 months to 2 years and deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 6 years. On the other hand, the crime of driving under the influence of alcoholic beverages is included in article 379 of the Penal Code and can be punished alternatively with prison terms of 3 to 6 months, a fine of 6 to 12 months, or work in benefit of the community from 31 to 90 days and in any case with deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 4 years. Likewise, the crime of driving a motor vehicle without ever having obtained a driving license, appears typified in article 384 of the Penal Code and can be punished alternatively with prison terms of 3 to 6 months, a fine of 12 to 24 months, or work for the benefit of the community from 31 to 90 days. On the other hand, the Civil Guard of the Region of Murcia wants to appeal to the civic conscience of the population, so that they notify the telephone 062 (Civil Guard) or 112 (Emergencies) or directly to the patrols on duty, when they encounter situations anomalous or irregular maneuvers that give rise to think that drivers do so under the influence of drugs or alcohol, in order to be able to adopt the appropriate police measures so that these vehicles are intercepted and checked if their drivers are in the appropriate conditions to circulate with safety guarantees, avoiding the consequent risk.
