The City Council of Los Alcázares has presented a document in the Regional Assembly for the political groups to present to the Congress of Deputies the Proposal of Law to give the Mar Menor legal personality (02/10/2020)

Said report warns about the existence of a cause of inadmissibility for processing considering that the matter on which the initiative relates corresponds to the competence of the state.

For his part, Mayor Mario Cervera explains that "the same initiative has also been raised before the General Courts by a group of people who have formally assumed the status of promoters before said state legislative body, so that it has already been accepted for processing.

". Cervera has said that "given the eventual inadmissibility of said legislative initiative, I am obliged to appear before the Bureau of the Regional Assembly in order to guarantee that it is approved by whoever has the competence to do so." In the document presented and signed by the Alcazareño councilor, he declares that, "as is clear and well-known, the Municipal Legislative Initiative starts a social clamor for the almost terminal state of degradation of the Mar Menor lagoon that arises from the riverside populations" . Although it was initially promoted by the Plenary of the Los Alcázares City Council, it has also received the support of the municipal plenary sessions of the San Pedro del Pinatar and San Javier City Councils. Given the general interest of this regulation for the Autonomous Community of the Region of Murcia, "I consider that its highest representative institution should be the one who assumes the responsibility of promoting the processing of this Initiative," adds Mayor Cervera. In addition, the representative of the coastal municipality, attached to his writing, the one made by Professor Teresa Vicente, head of the Chair of Human Rights and Rights of Nature at the University of Murcia, one of the promoters of this proposal of Law and defender of natural resources. In it, the professor explains that "if the Board of the Regional Assembly rejects the initiative because it considers that it is a matter for the State Legislation, nothing prevents that, in application of Article 154 a) of the Regulation of the Regional Assembly, it assumes the ILP of the Los Alcázares City Council as its own and present it before the General Courts as a Law Proposal. It also adds that, "the figure of recognition of the rights of nature and the legal personality of ecosystems is advancing throughout the world, also in Europe, and specifically in Spain.

Proof of this is the agreement adopted by the Mesa del Congress of Deputies, in its meeting on September 22, 2020, by which "the Proposal of Law for the recognition of legal personality to the Mar Menor lagoon and its basin is admitted for processing", presented in the Congress of the deputies dated July 29, 2020, at a time immediately after the presentation of the Proposal of Law "of the same content" in our Regional Assembly, as expressly stated by the Assembly's lawyer in its report ".
